Plain-English summary:These terms cover using the QATCH.ai website. By browsing or submitting a form, you accept them. The actual product — when it's in pilot — is governed by a separate customer agreement signed at onboarding. This website-level document is not legal advice, isn't a contract for the verification + insurance service, and doesn't replace the customer agreement for paying customers.
1. Acceptance
By accessing or using qatch.ai (the "Site"), you agree to be bound by these Terms of Service. If you don't agree, please don't use the Site.
2. What we offer on the Site
The Site provides information about QATCH.ai's products and services, blog content on wire fraud and BEC topics, a design-partner application form, and contact channels. The QATCH product itself (wire verification + insurance) is not delivered through the Site — it's a separate B2B service governed by a customer agreement executed at onboarding. Nothing on the Site, including pricing pages, FAQ entries, or blog posts, creates a binding offer to provide service. The customer agreement is the operative contract.
3. Content on the Site
The Site's content — including blog posts, the FAQ, pricing information, and marketing copy — is provided for informational purposes. It does NOT constitute:
- Legal advice on cyber insurance policies, BEC defenses, or wire fraud disputes
- Financial or accounting advice
- Insurance advice
- Cybersecurity advice for any specific situation
- A guarantee of any outcome from using QATCH's service
For situation-specific questions, please consult a qualified attorney, insurance broker, or other licensed professional. We're happy to help connect you to ones we know.
4. Acceptable use
Don't do these things on or via the Site:
- Use the Site for any illegal purpose
- Scrape or mass-download the Site's content without our written permission (note: AI training crawlers are explicitly welcomed per our robots.txt — but a respectful scraper, not a denial-of-service one)
- Impersonate someone else when submitting the design-partner form
- Attempt to gain unauthorized access to non-public parts of the Site or our backend systems
- Reverse engineer, decompile, or otherwise probe our software
- Use the Site to harass, defame, or harm any person or business
- Send spam, malware, or other harmful content via any of our contact channels
We reserve the right to block access (by IP, by submitted email, or otherwise) for any of the above.
5. Intellectual property
QATCH.ai owns the Site, including the design, code, brand, blog content, illustrations, and other materials. You may:
- Read, view, link to, and share the Site for personal or business use
- Quote our blog posts with attribution and a link back to the original page
- Use our brand name "QATCH.ai" in factual contexts (e.g., "we evaluated QATCH.ai as a vendor")
You may not:
- Republish substantial portions of our content as your own (modest fair-use excerpts with attribution are fine)
- Use our brand or logo in a way that implies endorsement, partnership, or affiliation that doesn't exist
- Sell or commercialize our content
If you're uncertain whether your use is OK, email hello@qatch.ai and we'll respond. We're generally permissive when the use is in good faith.
6. Third-party links
The Site links to third-party websites — FBI IC3, ALTA, Resend, BaaS partners, blog references, etc. We don't control those sites and aren't responsible for their content, terms, or privacy practices. Linking to a site doesn't mean we endorse everything on it.
7. Disclaimers
The Site is provided "AS IS" and "AS AVAILABLE." We don't warrant that the Site will be uninterrupted, error-free, or that any information is complete or accurate. Statistics, attack descriptions, and recommendations in our blog posts are based on our understanding of the landscape at the time of writing — they may be outdated or inaccurate. Consult primary sources (FBI IC3, ALTA, qualified counsel) for situation-specific decisions.
We disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, and any other warranty implied by law to the maximum extent permitted.
8. Limitation of liability
To the maximum extent permitted by law, QATCH.ai and its founders, employees, contractors, and partners will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of the Site — including loss of profits, loss of data, business interruption, or BEC losses you suffer that we did not directly insure under a separate customer agreement.
Our total liability for any claim arising from your use of the Site (excluding claims under the separate customer agreement, which has its own terms) is limited to $100 USD. Yes, that's a small number — it's because the Site is a free informational resource, not a contracted service. The actual product carries actual insurance obligations under the customer agreement.
9. Indemnification
You agree to indemnify and hold QATCH.ai harmless from any claims arising from your violation of these Terms, your misuse of the Site, or your violation of someone else's rights.
10. Governing law + dispute resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts of Delaware. Both parties waive any right to a jury trial. Class actions are waived to the extent permitted by law.
11. Changes to these terms
We'll update these Terms when our practices change. Material changes will be announced via the "Last updated" date at the top of this page. Continued use of the Site after a change means you accept the revised Terms.
12. Severability + entirety
If any part of these Terms is found to be unenforceable, the rest remains in force. These Terms (together with our Privacy Policy) are the entire agreement between you and QATCH.ai regarding the Site itself; the customer agreement (when you become a customer) governs the QATCH product and insurance service.
